Understanding EU Wine Label Regulations

EU wine labeling regulations

These European Union regulations ensure transparency and protect consumers by providing accurate information about the wine they purchase. Key regulations include Regulation (EU) No 1169/2011, Regulation (EU) No 1308/2013, Regulation (EU) No 2021/2117, and Regulation (EU) No 2023/1606, among others. They encompass various aspects such as wine ingredients, nutritional details, and allergen information.

Who needs to meet European wine labeling requirements?

The EU wine labeling regulations apply to European and non-European producers, importers, distributors, and anyone who imports and sells wine within the European Union. Compliance is mandatory, regardless of the wine's origin. For instance, a winery from the United States or Argentina must ensure that its wines comply with EU regulations if sold in the European Union and disclose the required wine ingredients on the wine label.

Can a wine producer develop a QR wine label accessible on its website?

No, hosting ingredient and nutritional information on a producer’s website does not meet EU requirements due to potential modifications and data tracking concerns. The amended CMO Regulation stipulates that the full nutritional declaration and list of ingredients must not be displayed with other information intended for sales or marketing purposes, and no user data shall be collected or tracked. The Commission explained that such use may not meet the legal requirements because websites managed by producers “can be easily modified at any time, even after the product is already on the market.” The EU Commission further clarified that the presentation of “the compulsory information as part of the producers’ website does not seem to comply with the conditions set out in Article 119(5), as the website of a wine producer is typically expected to contain commercial information relevant for marketing and/or sales. In addition, websites normally track information on the users.”

The order of ingredients

The list of ingredients shall be displayed in descending order of weight, as recorded at the time of their use in the production of wine. Ingredients constituting less than 2% of the finished product may be listed in a different order after the other ingredients.

No marketing info or data collection

Article 119(5) of the amended CMO Regulation provides that the information on the full nutritional declaration and list of ingredients shall not be displayed with other information intended for sales or marketing purposes, and that no user data shall be collected or tracked. There are no exceptions to this rule, and therefore it does not allow to request the user's consent on whether their data can be tracked.

QR code guidance

QR codes offer a modern way to present required information digitally, ensuring compliance while keeping the physical label clean and uncluttered. The amended CMO Regulation provides that both the nutrition declaration and the list of ingredients may be provided ‘by electronic means’ identified on the package or on a label attached thereto. However, the wine label cannot be fully digitized, as other label requirements in the European Union must still be included on the physical label of the wine. The wine QR code should be clear and easily scannable; typically, the QR code should be placed on the bottle's back label to avoid interfering with the primary product information.

Readability, Stability, Reliability, and Accuracy

The electronic means or platform used to display this information must provide the same guarantees as those required for information displayed on the package or attached label. This includes ensuring readability, stability, reliability, durability, and accuracy of the information throughout the product's life. The wine QR code should remain accessible in a way equivalent to a physical label, i.e., it should be available for at least the period that a specific category of wine is expected to remain suitable for consumption under normal storage conditions, ensuring consumers’ access to mandatory information throughout the product’s expected lifetime.

E-labels: information that may be presented electronically

While ingredients and nutritional information may be provided electronically through e-labels or QR code wine labels, all other wine labeling requirements—such as bottler, vendor, importer, provenance indication, minimum durability date for de-alcoholized or partially dealcoholized wines with an ABV of less than 10%, lot number, net quantity, among others—must appear on the physical label. If you choose to include allergens on the e-label, they must still be included on the physical label as well. Therefore, it is neither necessary nor practical to overload your e-label or QR-code label with additional symbols, data, or information that are not required for e-labels and must appear on physical labels.

Wines covered

Wines produced before December 8, 2023, may continue to be sold under previous labeling regulations until stock is exhausted. The new requirements will apply to wines placed on the market from December 8, 2023. For a detailed definition of “wine”, refer to the CMO Regulation, Annex VII, part 2.

Wine QR code presentation on the physical label

The QR code must be conspicuous, clearly indicating it links to nutrition and ingredient information. Article 13(1) of the FIC Regulation requires that mandatory information be clearly visible and legible. It shall not in any way be hidden, obscured, detracted from, or interrupted by any other written or pictorial matter or any other intervening material. Avoid generic symbols; instead, clearly state that the QR code refers to "Ingredients & Nutrition Info." Ensure the QR code is at least 4 x 4 cm (1.6 x 1.6 inches), printed in high resolution (at least 300 DPI), and includes a quiet zone around it. Any use of additional QR codes should not mislead or create confusion for consumers and should not detract any space from the one available for compulsory particulars, which would include the codes providing access to compulsory information by electronic means.

Energy values calculation

Energy values on wine labels derive from the wine's components, primarily alcohol and residual sugars, with trace amounts from other substances. Contributions from protein, fat, salatrims, and fiber are typically not included but can be added manually if applicable.

Language requirements

The regulations require that the information be provided in an official EU language that is easily understood by consumers. Most providers ensure availability in all 24 official EU languages.

Consequences of non-compliance

Non-compliance with EU wine labeling regulations, including fraudulent practices such as misrepresentation of origin or product characteristics, can result in penalties such as fines, product recalls, market withdrawal, suspension of marketing rights, and criminal prosecution, leading to severe legal consequences and sanctions.

Restriction to change the nutrition information or ingredients after generating a QR code

The EU Commission has clarified that the list of ingredients and nutrition declaration provided by electronic means must remain unchanged, just as they would on a physical label. This information is determined during the production phase and must remain consistent throughout the product’s life to ensure reliability for consumers. Any option to modify this data post-production should be avoided to prevent potential fraud.
